Overview
David represents business entities and individuals in all manner of disputes, including commercial litigation, government investigations, and shareholder lawsuits. He has represented clients in a wide array of industries—including health care, consumer goods, real estate and finance—in securities fraud litigation, derivative lawsuits, breach of contract and business tort matters, real estate litigation, and investigations conducted by the U.S. Securities and Exchange Commission (SEC) and U.S. Department of Justice (DOJ).
David has experience from the pre-lawsuit phase all the way through trial, post-trial motions, and appeals, and focuses his practice on achieving his clients’ objectives in the most efficient manner possible.
- Served as trial counsel in financial services litigation regarding loan documentation and related tort claims.
- Served as trial counsel in real estate litigation involving claims for breach of restrictive covenant and nuisance.
- Represented co-founder of AI software company in litigation against former business partner for breach of fiduciary duty and fraud.
- Represented financial institution in defense of fraud and unfair business practices litigation regarding lending practices.
- Represented public agency in breach of contract litigation brought by a developer concerning an option agreement and long-term ground lease.
- Represented property owner in litigation against a governmental agency and municipality concerning permitting issues.
- Represented government contractor in connection with investigations being conducted by the U.S. Department of Labor and DOJ.
- Represented residential real estate developer in class action litigation alleging fraudulent business practices and violations of consumer protection laws.
- Represented real estate investment firm in arbitration and litigation against developer for breach of contract and breach of fiduciary duty
- Represented CEO of a publicly traded company in connection with civil class action litigation and investigations by the SEC and DOJ.
- Represented publicly traded health care company in securities fraud litigation in connection with a public stock offering.
- Represented hedge fund in litigation alleging fraud, breach of contract, breach of fiduciary duty, and negligence in connection with fund’s investments.
- Represented consumer goods company in litigation brought by a former executive alleging breach of employment agreement, fraud, and other tort claims.
- Represented large shareholder of a publicly traded company in federal securities fraud litigation.
