Appellate

The Appellate Practice Group at Procopio provides specialized services in the post-trial and appellate areas in both the state and federal courts. In addition to being Certified by the State Bar of California Board of Legal Specialization as Appellate Specialists, our appellate attorneys prepare writs, appeals and motions for cases where we provided the original representation in the trial court, as well as for cases where we did not serve as trial counsel. Having a strong appellate group in the firm is important for clients who are involved in appellate proceedings, of course, but it also provides a substantial value-added benefit for any litigation client involved in significant trial court proceedings that may ultimately result in appellate review. Our appellate attorneys are willing to work closely with, or independently of, trial counsel according to the client's preference.

Experts in persuasive written and oral advocacy
Our appellate attorneys gravitated naturally to this group to take full advantage of their skills in brief-writing and oral argument. Prior to specializing in appeals, all clerked for a state or federal judge, then honed their skills in legal analysis, persuasive writing and oral argument as general litigators.

Extensive experience at the appellate court level
The attorneys in the Appellate Practice Group at Procopio have broad experience at distilling the massive amounts of information that can be generated in the trial court. Presenting the appropriate facts, issues and law to the appellate court from the voluminous trial and pretrial records is not an easy task, but our appellate attorneys take pride in responding to their clients' needs and the appellate courts' demands in a timely and efficient manner. Members of the group have recently filed briefs or presented oral arguments in the following appellate courts:

  • U.S. Supreme Court

  • U.S. Court of Appeals for the Ninth Circuit
  • U.S. Court of Appeals for the Tenth Circuit
  • U.S. Court of Appeals for the Federal Circuit
  • California Supreme Court
  • California Court of Appeal, Fourth Appellate District (San Diego, Santa Ana, Riverside)
  • California Court of Appeal, Third Appellate District (Sacramento)

  • California Court of Appeal, Second Appellate District (Los Angeles, Ventura)
  • California Court of Appeal, First Appellate District (San Francisco)
