Mr. Lormon specializes in environmental and land use law. He has extensive experience working with local and state government and regulatory agencies on permitting, entitlement, compliance, CEQA and enforcement matters. Mr. Lormon has handled project development, permitting compliance and enforcement issues. He is the leader of the Firm's Environment, Land Use and Governmental Affairs Practice Group.
Mr. Lormon has been lead counsel on urban, rural and agricultural land and project developments involving zoning, land use, specific and general plan issues. He represents clients on CEQA, endangered species, habitat, 404 permits, 401 water quality certification, wetlands, riparian, streambed alterations and vernal pool issues. He has negotiated purchase and sales agreements and conservation easements.
Mr. Lormon has represented clients on contaminated soil problems, has been lead counsel in Superfund PRP groups, has drafted and negotiated environmental provisions to facilitate property transfers including purchase, sale, and lease transactions and has negotiated cost recovery, underground storage tank, prospective purchaser protections, voluntary cleanup, Brownfield, Polanco Act, redevelopment agency and multiple party liability transactions.
Mr. Lormon has extensive experience on water quality permitting and enforcement matters dealing with WDRs and NPDES authorizations for industrial, wastewater, construction, and municipal discharges including discharges into areas of special biological significance (ASBS), contaminated sediment, cease and desist, and cleanup and abatement orders.
Mr. Lormon has managed numerous Clean Air Act cases involving stationary and mobile sources. He has special expertise in air emission impacts to local communities. Mr. Lormon has lead incident investigations involving pipeline, tanks and other catastrophic incidents. He has coordinated highly technical engineering, chemistry and physics reports, concerning process safety and risk assessments, where he developed response strategies and liability management.
Mr. Lormon has a diverse background working with the Boston Legal Aid Project, the Roxbury Defender, British Petroleum and the owner of the Trans-Alaskan Pipeline, Alyeska Pipeline Service Company. He has been active in politics and bond initiatives. He was team leader for Gray Cary Ware & Freidenrich's environmental and land use practice group for eight years before joining Procopio. He was appointed by the Governor to the California Regional Water Quality Control Board, San Diego Region 9 (1992 to 1996), and to the State Coastal Conservancy (1997 to 2004).

Representative Matters
- Clean Water Act and the California Water Code- Sections 401 Certifications, 402 NPDES and Section 404 - Dredge and Fill of waters in the U.S., including wetlands and vernal pools, and state waste discharge requirements including those subject to the National and California Toxic Rules permits. Lead counsel to Scripps Institution of Oceanography in obtaining NPDES permit and an exception to the California Ocean Plan prohibition on discharges to ASBSs. Compliance orders, cleanup and abatement orders, administrative, citizen suits, and civil and criminal enforcement matters. Industrial, wastewater, construction, and municipal permitting, compliance, and enforcement.
- Land Use - Lead advisor on residential project development, coordinating City Council, Planning Commission and staff meetings. Advise and coordinate density and density bonus issues, zoning, specific and general plan amendments, CEQA and project approvals.
- Purchase and Sale Transactions - Legal counsel and sales agent for large parcel sale, coordinated all contact with prospective purchasers including developers, Native American tribes and environmental groups.
- Conservation Easements - Draft and negotiate conservation easements with and for property owners, environmental groups, and resource agencies.
- Restoration - Manage all dealings with consultants and federal and state governmental agencies on wetlands and species restoration project.
- California Coastal Act - experience in developing and executing strategy to obtain Coastal Development Permits and Port Master Plan Amendments. Extensive experience with Coastal Commission and its staff.
- California Environmental Quality Act (CEQA) and National Environmental Policy Act (NEPA) - Legal counsel for residential, commercial, industrial and large public project approval and litigation matters.
- Contaminated Properties - underground storage tanks, oil and pipeline operations, landfill and burn dump sites, asbestos and PCB problems, lead negotiator and project strategist in placing contaminated property back into productive use under various federal and state Brownfield redevelopment agency and Polanco Act initiatives. Experienced in structuring deals to shield clients from environmental and natural resource exposures and to maximize property reuse.
- Comprehensive Environmental Responsibility Compensation & Liability Act (CERCLA/Superfund) and Resource Conservation Recovery Act (RCRA) - representation including Superfund litigation, removal actions, cost recovery and contribution actions, Brownfield projects, RCRA injunctive actions, and facility permitting.
- Natural Resources - federal and state permitting and enforcement issues, regarding endangered and threatened species, biological opinions, takings, import/export of CITES species, conservation easement, and habitat management including Natural Communities Conservation Planning matters.
- Clean Air Act - permitting, enforcement and citizen suit work with manufacturing, bulk loading, fumigation and other businesses and groups. Numerous appearances before the South Coast AQMD, San Diego APCD, State ARB and U.S. EPA. Clean Air Act PM-10, ozone, hazardous pollutant and other permitting and compliance matters.
- Indoor Air Pollution - negotiation of lease and purchase and sale agreements regarding liability and responsibility for mold and other indoor air pollution.

Mr. Lormon received his undergraduate and law degree from Boston College and is a member of the California, Alaska and Massachusetts Bars. In 2007 and 2008, he was selected for inclusion in the Southern California Super Lawyers® - San Diego
list in the Environmental category. Mr. Lormon is recognized as an AV rated attorney by Martindale-Hubbell.
Currently Mr. Lormon is a member of the Directors Cabinet for Scripps Institution of Oceanography and the co-chair of the Scripps Institution of Oceanography's Climate Initiative Task Force.
